County Coroner; It was his son, Robert, that obtained 1/3 of the Walton estate
when he married Hellen (Ellen de Walton); before then he tried to take the
estate by force. According
to Derek Whales' book, "Lost Villages of Liverpool", the office of
county coroner "held considerable power in those days"

(son of Thomas) and abt. 100 other men attacked the Walton Manor and
"dispossessed John de Walton his wife and children and taking away his
chatels there".
Under direction
from parliament, Sir Thomas Gerrard and others were commissioned to remove
Robert from Walton Hall. He was informed by the sheriff that "he would be fined 100 £
unless he left John de Walton to live peacefully in his manor", The dispute
was not settled until 1426 when Robert was awarded 1/3 of Walton Manor in lieu
of his marriage to Ellen de Walton; this included 40 acres of land in Walton
& Liverpool & included property of Thos. Spellow (Spellow house built
1270); 2nd house built 1611

August 1650. Claimants on the estate of Nich. Fazakerly (late) Spellowe House;
Robert, his son, Walton-juxta-Liverpool; Thomas and William sons of Robert
Fazakerly, all Co Lancs. The Fazakerley's were Roman Catholic and Royalists during the time of the civil war, and this cost them dearly. On the 12th of May 1649, parliament awarded the town of Liverpool the sum of £10,000 to be "extracted" from five families in the area, one of which was the Fazakerley family. The lands of both Nicholas Fazakerley of Fazakerley Hall (killed in the war, in Liverpool, aged 41 in Oct 1643) and his father Robert Fazakerley of Spellow House, Walton (killed in the war, in Chester, 5th April 1643.) were confiscated by parliament and sold. The charge was Treason
Roger
Breres, of Walton, married to a dau. of Robert, (see below) stated that Nicholas
& his brothers, Robert & Richard were dead. Robert died at Chester, abt
1643; Nicholas at Liverpool, 1644; Robert, The younger, in the Indes; &
Richard in Ireland, 1642. Their
lands were confiscated by the Act of 1652. Some property was recovered later Robert
died at Chester on Apr. 5; 1643; Anne (‘of
Spello-house’) died in March 1665
and was buried at Aughton on 30 March. His
will dated 1639 names children Nicholas, Thomas William, Richard, Robert,
Margery and Ellen Her
will, dated 1655, names her children Thomas, William and Ellen, grandson

Nicholas,
under the alias of Ashton was admitted to the English College at Rome in
1623 giving his age as 23. In 1626 he returned to England and married Catharine
Peacock, dau. of John Peacock of Chichester, Sussex, abt December 1638. He
obtained a Captain's commission in the King’s Army and lost his life when
Liverpool was captured by the Parliamentarians in Oct 1643

Thomas,
b 1611 became a priest in 1635. Died in 1664-5, buried Hardkirke, Little Crosby Thomas
entered the English College at Rome in 1629 aged 18 under the same alias
as his brother Nicholas. He stated that he was ‘born and brought up in
Lancashire, his parents were of high family and always Catholics. His friends
were likewise of the upper class, some being Catholics and some heretics. He had
made his humanities at St Omer’s for five years’. He was made priest and
returned to England in 1636. 6

Molyneux of the Wood (1664). Mossborough Hall became the chief home of that branch of the family. Thomas Fazakerley’s will leaves certain items to his Master and Mistress Molyneux.
